Jev BAA vs OpenAI Decisions BAA: Why Jev Can't Take PHI and OpenAI Decisions Can on Concentrate
OpenAI Decisions gets HIPAA coverage through Concentrate's BAA, while Jev does not.

Jev, TypeSafe AI's decision model, is not covered by a BAA: TypeSafe has no public BAA offering or HIPAA statement for Jev, and Jev is not BAA-eligible on Concentrate, so it should not receive protected health information (PHI). The OpenAI Decisions API runs on GPT-6 Luna, which OpenAI says supports HIPAA use for eligible customers, and GPT-6 Luna on OpenAI is BAA-eligible on Concentrate. With a signed Concentrate BAA, a HIPAA-enabled organization and routing limited to BAA-eligible providers, you can use OpenAI Decisions with patient data and medical records.
Is Jev HIPAA compliant? Does TypeSafe sign a BAA for Jev?
Not that we can find. We found no public BAA offering or HIPAA statement from TypeSafe AI for Jev, and TypeSafe's terms of use do not mention HIPAA, PHI or Business Associate Agreements.
On Concentrate, Jev 1.14 (jev-1.14.0, released October 14, 2026) is served by one provider, TypeSafe AI (typesafe/jev-1.14.0), and that provider is not BAA-eligible. Under HIPAA the rule is simple: no signed BAA, no PHI. If you are classifying clinical notes, triaging patient messages or routing claims with Jev today, that traffic should not contain PHI.
What is the OpenAI Decisions API?
The OpenAI Decisions API answers typed questions with probabilities instead of generated text. It became generally available on October 22, 2026, at POST /v1/decisions, and GPT-6 Luna is the only supported model.
Question types: predicate (a probability from 0 to 1), choice (one option from a list you supply) and score (ordered levels).
Inputs: text, images and JSON, with 1 to 400 questions per request.
Price: $0.10 per million uncached input tokens on OpenAI; output tokens are not billed.
Data controls: OpenAI's guide says the Decisions API supports Zero Data Retention and HIPAA use for eligible customers.
It does the same job as Jev: fast yes/no, pick-one and scoring calls inside agents and workflows. The difference for healthcare teams is BAA coverage.
Can you get a BAA for OpenAI Decisions?
Yes, through Concentrate. GPT-6 Luna is BAA-eligible on 2 of its 3 providers on Concentrate, and Concentrate's catalog lists the Decisions endpoint on the OpenAI provider. One Concentrate BAA covers the gateway and the inference on BAA-eligible providers, so you do not negotiate a separate agreement with each model provider.
Today, BAA-eligible providers for GPT-6 Luna on Concentrate include OpenAI and Azure.
Examples as of November 2026. Output price is GPT-6 Luna's standard rate; OpenAI does not bill output tokens on Decisions requests. See Model Fortress for the live list.

Which other decision models are BAA-eligible on Concentrate?
OpenAI Decisions isn't the only option. Baseten's decision models are also BAA-eligible on Concentrate, and we're adding more decision models under our BAA.
Mammoth 1 is Baseten's 27B decision model, post-trained from Qwen3.5-27B, for decisions that need broader general knowledge. Elephant 1 is its 9B decision model, post-trained from Qwen3.5-9B. Both answer typed questions about supplied state with calibrated probabilities instead of generated text, the same job Jev does, and both were released on October 21, 2026. Elephant 1 matches Jev's $0.04 per million input tokens on Concentrate, with BAA coverage.
What do you need to use OpenAI Decisions with PHI?
You need three things:
A signed BAA with Concentrate. BAA access is a $499/month subscription, with no per-request fees and no markup on tokens.
A HIPAA-enabled organization on Concentrate.
Routing limited to providers marked BAA-eligible, such as OpenAI for Decisions.
Under HHS guidance, a cloud or AI service that handles ePHI for you must sign a BAA. Your organization still owns its own HIPAA obligations, such as access policies and minimum-necessary use.
How does Concentrate keep PHI on BAA-eligible providers?
Provider allowlisting: restrict a HIPAA organization to BAA-eligible providers so PHI cannot route anywhere else.
Live eligibility: every model page shows which providers are BAA-eligible right now.
Redaction: PII and PHI can be redacted before a request leaves the gateway.
Access control: SSO and role-based access control decide who can send what.
Is Jev HIPAA compliant?
We found no public HIPAA statement or BAA offering from TypeSafe AI for Jev, and Jev is not BAA-eligible on Concentrate. Without a signed BAA, do not send PHI to Jev.
Can I get a BAA for Jev?
Not through Concentrate today. Jev's only provider on Concentrate, TypeSafe AI, is not BAA-eligible. Ask TypeSafe directly, in writing, before sending any PHI.
Is the OpenAI Decisions API HIPAA compliant?
HIPAA compliance belongs to the deployment, not the API. OpenAI says Decisions supports HIPAA use for eligible customers; on Concentrate you need a signed BAA, a HIPAA-enabled organization and routing limited to BAA-eligible providers.
Can I get a BAA for OpenAI Decisions?
Yes. Concentrate signs a BAA that covers GPT-6 Luna on the OpenAI provider, which serves Decisions. It is a $499/month subscription with no per-request fees and no markup on tokens.
Which providers serving GPT-6 Luna are BAA-eligible?
Today, BAA-eligible providers for GPT-6 Luna on Concentrate include OpenAI and Azure. We keep adding BAA-eligible providers; see Model Fortress for the live list.
Is there a BAA-covered alternative to Jev?
Yes. OpenAI Decisions on GPT-6 Luna and Baseten's Mammoth 1 and Elephant 1 decision models are BAA-eligible on Concentrate, and more decision models are coming.
Can I use OpenAI Decisions with patient data or medical records?
Yes, once your BAA is signed, your organization is HIPAA-enabled and PHI routes only to BAA-eligible providers.
Does Concentrate sign a BAA?
Yes. BAA use is $499/month, with no per-request fees and no markup on tokens. Use without a BAA has no subscription fee. See concentrate.ai/compliance.
Does one BAA cover other models?
Yes. One Concentrate BAA covers every model on a BAA-eligible provider, including GPT, Claude and Gemini models. Browse them on Model Fortress.
